01The service

WakeStake is an alarm clock that requires you to complete a wake-up mission (for example, physical movement verified by your device's sensors and camera, mental math, or writing a daily intention) before an alarm can be dismissed. Optional features include wake-up streaks, recorded proof clips, accountability messages, and the voluntary money stakes described in Section 4.

02Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use money stakes.

03Subscriptions

Pro subscriptions (monthly, annual, lifetime) are billed through the Apple App Store or Google Play under their terms. Free trials convert to paid unless cancelled before the trial ends. Manage or cancel in your store account settings.

04Money stakes — the commitment device

Money stakes are an optional, voluntary commitment device. They are not gambling, a wager against other people, an investment, or a game of chance: you can never win or receive money — you can only avoid a charge by completing your mission on time.

4.1 How a stake works

When you enable a stake on an alarm, you authorize us to charge your saved payment card if you do not complete that alarm's full wake-up mission within 30 minutes of the alarm's scheduled time (the "deadline"). If you complete the mission by the deadline, nothing is charged.

4.2 Escalation while ringing

The amount at risk starts at a floor (for example $5) and increases at stated intervals while the alarm goes unanswered, up to the maximum you chose when setting the stake — never more than $100 per stake. The current amount is shown (and spoken) while the alarm is ringing.

4.3 Escalation across mornings (optional)

If you enable "raise it when you lose," each charged miss raises the minimum stake for that alarm's next commitment to three times the charged amount, up to the ceiling you chose — never more than $100. Completing a mission on time resets this ladder. The adjusted amount is shown before each commitment takes effect.

4.4 Consecutive-charge limit

After three consecutive charged misses on the same alarm with no completed mission in between, further misses on that alarm are recorded but not charged until you next complete a mission on time. This limit exists so a stake cannot silently drain a card you have stopped engaging with.

4.5 Lockout

A pending stake can no longer be edited or cancelled during the final hour before its deadline (or after it). Until the lockout you may cancel or change it freely in the app.

4.6 Where the money goes — fee disclosure

If a stake is charged, the full amount is retained by us as the commitment-service fee, covering payment processing, verification, and operation of the commitment system. Forfeits are not donations, purchases of goods, or wagers; no part of a forfeit is paid to you or to any other user. This is disclosed in the app before every stake is enabled.

4.7 Streak challenges

A streak stake covers consecutive scheduled wake-ups. One missed wake-up ends the challenge and triggers one charge; remaining nights in that challenge are voided, not charged.

4.8 Streak insurance

A purchased "streak save" is applied automatically at settlement to void one miss instead of charging it (and suppresses that miss's accountability message). Streak saves are consumable in-app purchases under the app stores' terms.

4.9 No refunds — automatic fairness instead

All stake charges are final. There is no refund process. Instead, fairness is enforced automatically: completing your mission creates a completion record on your device; if that record reaches us late (for example, you were offline when you woke), any charge already made for that alarm is automatically reversed. You cannot trigger this by any means other than having actually completed the mission on time. You may also file an appeal from the app before a pending charge settles; appeals are reviewed by a person.

4.10 Your responsibilities

You are responsible for keeping your device charged, powered on, connected when possible, and with alarm and notification permissions enabled. If your device is off, out of battery, or otherwise unable to sound the alarm, you may still be charged. We are not responsible for missed alarms caused by device conditions, operating-system behavior, or connectivity. You acknowledge this in the app each time you enable a stake.

4.11 Verification

Missions are verified by device sensors and, for movement missions, the front camera. For stakes of $50 or more, a short video clip of your mission is uploaded to our servers solely to verify completion and is deleted immediately after verification. Clips are not shared, sold, or used for any other purpose. Falsifying verification (including modifying the app) is a breach of these terms.

4.12 Payment processing

Stake payments are processed by Stripe, not through the app stores. You authorize off-session charges to your saved card for stakes you enable, up to the disclosed maximum. We never see or store your full card number.

05Camera, sensors, and recordings

Movement missions use the camera and motion sensors while the mission screen is open. Proof clips of your mornings are stored on your device; you can delete them at any time. Except as described in 4.11, recordings do not leave your device.

06Health disclaimer

Wake-up missions involve light physical activity (for example jogging in place, squats, push-ups, sit-ups). Choose missions appropriate to your health; stop if you feel pain or dizziness. The app is not medical advice or a medical device.

07Acceptable use and termination

Don't use the app to break the law, interfere with the service, or falsify mission verification. We may suspend or terminate accounts that breach these terms. You may delete your account at any time from the app; doing so cancels any stake that is still cancellable (one already inside its final-hour lockout settles as scheduled), and your data is handled as described in the Privacy Policy.

08Liability

The app is provided "as is". To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the service is limited to the greater of the amounts you paid us in the twelve months before the claim or one hundred US dollars. Nothing in these terms limits liability that cannot lawfully be limited.

09Changes and contact

We may update these terms; material changes to how stakes work are shown in the app before your next stake is enabled. These terms are governed by the laws of the jurisdiction in which New Day Industries LLC is organized. Questions: support@wakestake.app.
